eking to hire permanent personnel ("Candidates").
Generally, your Placement Customers will be located within your Area. However, you may service Placement Customers and Candidates from anywhere within or outside of your Area except for the following restriction: If you obtain a request to fill a position ("job order") outside of your Area, you must first offer the agency (i.e. an agency operated by any of our affiliates or other franchisees or licensees) that operates in that location the opportunity to fill that job order. If the customer request is not referred to the agency office that operates in that location, you will be charged a fine of $1,000 for the first violation, $2,500 for the second violation and $5,000 for the third and each subsequent violation. In addition, you will be required to pay restitution of the profit you derived from the wrongfully-performed services to the agency that services that area, as applicable. What This Means (2025 FDD)
According to All Team's 2025 Franchise Disclosure Document, Placement Customers are generally located within the franchisee's designated Area. The Area is defined in Exhibit I of the Franchise Agreement as a Metropolitan Statistical Area (MSA) as defined by the U.S. government. Franchisees must operate the Placement Business within their Area out of the same office(s) that the Temporary Service Business is operated. The customers for the Placement Business are those seeking to hire permanent personnel, referred to as Candidates.
While franchisees primarily service customers within their designated Area, there are exceptions. Franchisees may service Placement Customers and Candidates from anywhere within or outside their Area. However, if a franchisee obtains a request to fill a position outside of their Area, they must first offer the opportunity to fill the job order to the All Team agency that operates in that location. Failure to do so results in a fine: $1,000 for the first violation, $2,500 for the second, and $5,000 for the third and subsequent violations. The franchisee will also be required to pay restitution of the profit derived from the wrongfully performed services to the agency that services that area.
There are further stipulations regarding National/Regional Accounts. These are accounts with more than one location covered by an agreement for services not solely within one franchisee's area. These accounts are negotiated and managed solely by All Team, even if a franchisee procures the account. If locations of a National/Regional Account fall within a franchisee's Area, All Team will first offer the franchisee the opportunity to provide services under the established terms. However, the final decision rests with the National/Regional Account. These accounts are billed by All Team, and customer payments are sent to All Team, who then forwards the amounts to the franchisee.
Prospective franchisees should be aware of these territorial guidelines and the potential for competition, as All Team does not grant exclusive territories. Franchisees may face competition from other franchisees, company-owned outlets, or other channels of distribution. Understanding these conditions is crucial for assessing the potential market and operational scope of an All Team franchise.
