If an All Team franchisee obtains an account that qualifies as a National/Regional Account, what are they required to do?

If you obtain an account that is considered a National/Regional Accounts, you must refer it to us and it will be treated as a National/Regional Account; however, we reserve the right to reject any such account in our sole judgment and discretion. National/Regional Accounts will be negotiated solely by us or our affiliates, even if you procure the National/Regional Account. All National/Regional Accounts will be considered our property and you will have no claim to them. As such, all National/Regional Accounts and related agreements will be negotiated, managed, and controlled solely by us even if you procure the National/Regional Account. If one or more locations of a National/Regional Account fall within your Area, we will first offer you the opportunity to provide such services on the terms and conditions that have been established with such National/Regional Account. You are not required to service a National/Regional Account and if you do not accept such offer in the manner and within the time period that we specify, we have the right to service the account ourselves, or may authorize other franchisees, licensees, or affiliate-owned agencies, to provide such services. Even if you fail to accept the job order to service a certain National/Regional Account, you may fill subsequent job orders once you have temporary staff or personnel candidates available. However, the decision to accept you as a provider of services for the National/Regional Account must ultimately rest with the National/Regional Account. All National/Regional Accounts will be billed by us, and Customer payments for National/Regional Accounts will be sent to us and we will forward these amounts to you.

What This Means (2025 FDD)
According to All Team's 2025 Franchise Disclosure Document, if a franchisee obtains an account that is considered a National/Regional Account, they must refer it to All Team. A National/Regional Account is defined as a Temporary Service Business and Permanent Placement Business account with more than one location covered by an agreement for services not located solely in one franchisee's area. However, All Team reserves the right to reject any such account at their discretion. National/Regional Accounts will be negotiated solely by All Team or its affiliates, even if the franchisee procures the account, and these accounts are considered All Team's property, giving the franchisee no claim to them.
If one or more locations of a National/Regional Account fall within a franchisee's area, All Team will first offer the franchisee the opportunity to provide services under the terms and conditions established with the National/Regional Account. The franchisee is not required to service the account, and if they decline the offer within the specified time period and manner, All Team has the right to service the account themselves or authorize other franchisees, licensees, or affiliate-owned agencies to do so. Even if a franchisee initially declines to service a National/Regional Account, they may fill subsequent job orders once they have temporary staff or personnel candidates available, but the final decision rests with the National/Regional Account.
All Team will handle the billing for National/Regional Accounts, and customer payments will be sent to All Team, who will then forward the appropriate amounts to the franchisee. This arrangement centralizes the management and control of National/Regional Accounts with All Team, ensuring consistency and potentially leveraging economies of scale. However, it also means that franchisees are dependent on All Team for payment processing and must adhere to the terms and conditions set by All Team for these accounts.
