If an All Team franchisee declines to service a National/Regional Account, what rights does All Team have?

All_Team Franchise · 2025 FDD

Answer from 2025 FDD Document

If one or more locations of a National/Regional Account fall within your Area, we will first offer you the opportunity to provide such services on the terms and conditions that have been established with such National/Regional Account. You are not required to service a National/Regional Account and if you do not accept such offer in the manner and within the time period that we specify, we have the right to service the account ourselves, or may authorize other franchisees, licensees, or affiliate-owned agencies, to provide such services. Even if you fail to accept the job order to service a certain National/Regional Account, you may fill subsequent job orders once you have temporary staff or personnel candidates available. However, the decision to accept you as a provider of services for the National/Regional Account must ultimately rest with the National/Regional Account. All National/Regional Accounts will be billed by us, and Customer payments for National/Regional Accounts will be sent to us and we will forward these amounts to you.

What This Means (2025 FDD)

According to All Team's 2025 Franchise Disclosure Document, franchisees are not required to service National/Regional Accounts. If an All Team franchisee declines an offer to service a National/Regional Account within the timeframe and manner specified by All Team, All Team has the right to service the account themselves. Alternatively, All Team may authorize other franchisees, licensees, or affiliate-owned agencies to provide the services.

This policy regarding National/Regional Accounts is important for prospective All Team franchisees to understand. National/Regional Accounts are defined as Temporary Service Business and Permanent Placement Business accounts with more than one location covered by an agreement not solely within one franchisee's area. These accounts are negotiated and managed solely by All Team, even if the franchisee initially procures the account.

The FDD states that All Team will first offer the franchisee the opportunity to service locations of a National/Regional Account that fall within their designated area, under the terms and conditions established with the account. However, the franchisee's refusal allows All Team to ensure the account is serviced, either directly or through another party. Despite a franchisee's decision not to accept a job order, they may still be considered for subsequent job orders, although the ultimate decision rests with the National/Regional Account itself. All National/Regional Accounts are billed by All Team, who then forwards the appropriate amounts to the franchisee.
