Nothing in this Section shall be construed to require Franchisor to approve any particular supplier, or to require Franchisor to make available to prospective suppliers, standards and specifications that Franchisor deems confidential.

13.2 Appearance and Condition of the Franchised Business

What This Means (2024 FDD)

According to All States M.E.D.'s 2024 Franchise Disclosure Document, All States M.E.D. is not required to approve any particular supplier. However, All States M.E.D. may provide franchisees with a list of specifications and Approved Suppliers in the Operations Manual or other written form for supplies, furniture, fixtures, inventory, equipment, and other approved items and services. All States M.E.D. can revise this list from time to time.

If a franchisee wants to use products, services, or new technology that All States M.E.D. hasn't approved, the franchisee must first give All States M.E.D. enough information, specifications, and samples to decide if the service or product meets its standards or if the supplier meets its criteria for approval. The franchisee will pay up to $1,000 for All States M.E.D.'s costs to review the item, service, or supplier. All States M.E.D. will then decide within a reasonable time, usually 30 days, whether the franchisee can buy or lease the items or services from that supplier.

Approval of a supplier can depend on their ability to provide enough product, the quality of their products or services at competitive prices, their production and delivery capability, and their dependability and general reputation. All States M.E.D. also has the right to retain volume rebates, markups, and other benefits from suppliers, and the franchisee has no claim to these benefits. All States M.E.D. is not required to make available to prospective suppliers standards and specifications that All States M.E.D. deems confidential.
