What This Means (2024 FDD)

According to the 2024 All States M.E.D. Franchise Disclosure Document, USPTO stands for the U.S. Patent and Trademark Office. All States M.E.D. indicates that the franchise agreement grants franchisees the right to use the trademarks that are registered or have applications pending with the USPTO.

All States M.E.D. clarifies that it does not currently have a federal registration for its principal trademark. As a result, the trademark lacks the full legal protections afforded to federally registered trademarks. This creates a risk for franchisees, as they may be required to switch to an alternative trademark if the franchisor's right to use the current trademark is challenged. This change could lead to increased expenses for the franchisee.

Furthermore, on February 14, 2024, the USPTO issued a Nonfinal Office Action regarding All States M.E.D.'s trademark application for "All States M.E.D." (Serial No. 97936826). The USPTO raised concerns about the service identification, multiple class application requirements, and an unacceptable owner name change. All States M.E.D. has not yet responded to this action. If All States M.E.D. cannot resolve these issues, it will not be able to obtain federal trademark registration for the mark.
