What This Means (2024 FDD)
According to All States M.E.D.'s 2024 Franchise Disclosure Document, Minnesota law requires that All States M.E.D. provide franchisees with 180 days' notice for non-renewal of the franchise agreement. This requirement is outlined in the Minnesota Addendum to both the Disclosure Document and the Franchise Agreement. This provision ensures that franchisees operating in Minnesota have ample time to prepare for the end of their franchise term and to make necessary arrangements, whether that involves seeking renewal, selling the business, or winding down operations.
This extended notice period is designed to protect franchisees by giving them sufficient time to evaluate their options and mitigate potential losses associated with the non-renewal of their franchise agreement. It also allows franchisees to engage in negotiations with All States M.E.D. regarding the terms of a potential renewal, if desired. The 180-day notice period for non-renewal is significantly longer than the 90-day notice period required for termination (with 60 days to cure), highlighting the importance of providing franchisees with adequate time to plan for the future of their business.
Prospective All States M.E.D. franchisees in Minnesota should be aware of this provision and understand their rights regarding non-renewal. They should also consult with legal counsel to fully understand the implications of Minnesota franchise law and how it may affect their franchise agreement. This requirement ensures that All States M.E.D. franchisees in Minnesota are afforded certain protections under state law, particularly concerning the termination or non-renewal of their franchise agreements.
