  • 13.1.3 Franchisor has the right to designate certain products and services, not otherwise authorized for general use as part of the System, to be offered locally or regionally based upon such factors as Franchisor determines including, but not limited to, franchisee qualifications, test marketing and regional or local differences.

Franchisor has the right to give its consent to one (1) or more franchisees to provide certain products or services not authorized for general use as part of the System.

Such consent will be based upon the factors in Section 10.4 and shall not create any rights in Franchisee to provide the same products or services.

What This Means (2024 FDD)

According to the 2024 All States M.E.D. Franchise Disclosure Document, All States M.E.D. has the right to allow one or more franchisees to offer specific products or services that are not typically authorized for general use within the All States M.E.D. system. This consent is based on factors determined by All States M.E.D., as outlined in Section 10.4 of the agreement. The grant of this consent to one franchisee does not automatically give other franchisees the right to offer the same products or services.

This means that an All States M.E.D. franchisee cannot assume they can provide a product or service simply because another franchisee has been authorized to do so. Each franchisee's ability to offer non-standard products or services is subject to individual approval by All States M.E.D.

This policy allows All States M.E.D. to test market new offerings, accommodate regional differences, or leverage specific franchisee qualifications without broadly mandating changes across the entire system. As a prospective franchisee, it is important to understand that the products and services you are initially approved to offer may not be the full range of possibilities within the All States M.E.D. system, and adding new offerings requires franchisor approval.
