What This Means (2024 FDD)
According to the 2024 All States M.E.D. Franchise Disclosure Document, the Franchisee Disclosure Questionnaire, labeled as Exhibit H, is not to be used for franchise sales in or to residents of Virginia, along with several other states. This means that All States M.E.D. franchisees in Virginia will not be required to complete this questionnaire as part of the franchise sales process.
The Franchisee Disclosure Questionnaire is designed to determine if any unauthorized or untrue statements were made to the prospective franchisee. It also confirms that the franchisee has been properly represented and understands the limitations on claims related to their franchise. The document emphasizes that the questionnaire cannot be signed or dated on the same day as the Receipt for the Franchise Disclosure Document but must be signed and dated on the same day the Franchise Agreement is signed and the franchise fee is paid.
The exclusion of Virginia and other states (CA, HI, IL, IN, MD, MI, MN, NY, ND, RI, SD, WA, WI) from using this questionnaire suggests that All States M.E.D. may have alternative methods or documentation to ensure compliance with franchise regulations in those specific states. Prospective franchisees in Virginia should inquire with All States M.E.D. about the specific procedures and documents required for franchise sales in their state to ensure they meet all necessary legal and contractual obligations.
