Answer from 2024 FDD Document

You and we are preparing to enter into a Franchise Agreement. This Acknowledgement is to determine whether any statements or promises were made to you that we did not authorize or are untrue, inaccurate or misleading, to ensure you have been properly represented, and that you understand the limitations on claims you may make relating to your franchise. You cannot sign or date this Acknowledgement the same day as the Receipt for the Franchise Disclosure Document. You must sign and date it the same day you sign the Franchise Agreement and pay your franchise fee. Please review each of the following questions carefully and provide honest responses.

What This Means (2024 FDD)

According to All States M.E.D.'s 2024 Franchise Disclosure Document, the Franchisee Disclosure Questionnaire cannot be signed and dated on the same day as the receipt for the Franchise Disclosure Document. It must be signed and dated on the same day the Franchise Agreement is signed and the franchise fee is paid. This suggests that signing the questionnaire prematurely could be a deviation from the intended process.

The purpose of the Franchisee Disclosure Questionnaire is to ensure that prospective franchisees have not received any unauthorized or misleading statements, have been properly represented, and understand the limitations on claims they can make. By requiring the questionnaire to be signed only upon signing the Franchise Agreement and paying the fee, All States M.E.D. aims to confirm that the franchisee's understanding and representations are current and accurate at the point of commitment.

While the FDD excerpt specifies when the Franchisee Disclosure Questionnaire should be signed, it does not explicitly state the consequences of signing it before paying the franchise fee. A prospective franchisee should seek clarification from All States M.E.D. regarding the implications of non-compliance with the specified timing. This inquiry would help clarify whether early signing invalidates the questionnaire, affects the franchisee's rights, or has other legal ramifications.
