Each additional Franchised Business must be open according to the Development Schedule described in the ADA, which will specify the number of Franchised Businesses to be open and the time frames within which they must be open. In the event that you fail to meet the mandatory Development Schedule, and the ADA is terminated, you will retain your rights to any individual Franchised Businesses, including the territorial rights described in the Franchise Agreement for such Businesses, provided that the ADA was not terminated as a result of your failure to comply with the terms of your existing Franchise Agreement(s). Your rights to any Businesses for which there is no Franchise Agreement and your protection in the Development Area will terminate immediately. Thereafter, we will have the right to develop the Development Area on our own or through third parties.

What This Means (2025 FDD)
According to All Dogs Unleashed's 2025 Franchise Disclosure Document, the Development Schedule outlined in the Area Development Agreement (ADA) serves to specify the number of All Dogs Unleashed Franchised Businesses that an area developer must open, as well as the timeframes within which they must be opened. The ADA grants the developer the right to establish three or more Facilities within a defined geographical territory. The number of Facilities required may be adjusted based on factors such as population density and the characteristics of the area.
If an All Dogs Unleashed area developer fails to meet the mandatory Development Schedule and the ADA is terminated, the developer retains rights to any individual Franchised Businesses for which they have a Franchise Agreement, including the territorial rights associated with those businesses, provided the ADA termination wasn't due to a breach of the existing Franchise Agreement. However, rights to any businesses without a Franchise Agreement and territorial protection within the Development Area are immediately terminated.
Following termination of the ADA due to failure to meet the Development Schedule, All Dogs Unleashed reserves the right to develop the area independently or through other third parties. This underscores the importance of adhering to the Development Schedule, as failure to do so can result in the loss of developmental rights within the area, allowing All Dogs Unleashed to pursue other avenues for expansion in that territory. This is a common practice in area development franchise agreements, where franchisors set development targets to ensure market penetration and growth.
