What is the dependency between the Franchise Agreement and the use of the Premises for an All Dogs Unleashed Facility?

According to the 2025 All Dogs Unleashed FDD, the Franchise Agreement dictates the use of the premises for an All Dogs Unleashed facility. The Franchise Agreement grants the franchisee the right to operate a facility at an approved location, and the premises will be used only for the operation of the All Dogs Unleashed Facility during the term of the Franchise Agreement.

All Dogs Unleashed has the right to approve the site for the Facility. If the Facility premises will be occupied pursuant to a commercial lease, All Dogs Unleashed has prescribed certain lease terms and has the right to condition its approval of a proposed site on inclusion of the prescribed lease terms. The landlord consents to the franchisee's use of All Dogs Unleashed's marks, signs, interior and exterior décor, furnishings, fixtures, items, color schemes, plans, specifications, and related components of the All Dogs Unleashed System.

This means a franchisee cannot operate any other type of business from the approved location. The franchisee's ability to remain in possession of the facility premises is also a condition for renewal of the franchise agreement. The landlord must also agree to furnish All Dogs Unleashed with copies of any and all letters and notices sent to Franchisee pertaining to the Lease and the Premises at the same time that such letters and notices are sent to Franchisee.
