What This Means (2025 FDD)
Based on the 2025 All Dogs Unleashed Franchise Disclosure Document, the agreement stipulates that upon termination or expiration of the agreement, the franchisee must cease all use of the Marks, Copyrighted Works, and Confidential Information.
In a Personal Guaranty and Undertaking, the document states that the Owner will comply with the provisions concerning the Franchisee's use of Franchisor's Marks and Copyrighted Works, as each term is defined in the Franchise Agreement. It specifies that the Owner has no individual right to use the Marks or Copyrighted Works, and no ownership interest in them, except for the license granted to the Franchisee.
However, the excerpts provided do not explicitly define 'Copyrighted Works' or state whether this definition includes training guides. For a prospective franchisee, it is important to understand exactly what materials are included under 'Copyrighted Works' to ensure compliance with the franchise agreement, especially regarding usage during the franchise term and obligations upon termination.
