- 17.3. Proportionality. We undertake no obligation to ensure that expenditures by the Advertising Fund in or affecting any geographic area are proportionate or equivalent to the contributions to the Advertising Fund by ALL COUNTY® businesses operating in that geographic area.
Nor are we under any obligation to ensure that any ALL COUNTY® business will benefit directly or in proportion to its Ad Fees paid to the Advertising Fund from the development of advertising and marketing materials or the placement of advertising.
Except as expressly provided in this Article, we assume no direct or indirect liability or obligation to you with respect to collecting amounts due to, maintaining, directing, or administering the Advertising Fund.

What This Means (2025 FDD)
According to All County's 2025 Franchise Disclosure Document, All County is not obligated to ensure that each individual All County business directly benefits from advertising and marketing materials in proportion to their Ad Fees paid to the Advertising Fund. The document states that All County assumes no direct or indirect liability to franchisees regarding the Advertising Fund, except as expressly provided.
All County may spend more or less on the Advertising Fund in any fiscal year than the aggregate contribution of all All County businesses and may borrow or invest surplus funds. Interest earned on the Advertising Fund will be used to pay advertising costs before other assets are used. Franchisees can request an annual compiled statement of monies collected and costs incurred by the Advertising Fund.
This means that while franchisees are required to contribute to the Advertising Fund, there is no guarantee that their specific location or territory will see a direct or proportional benefit from the advertising efforts. The allocation of advertising resources is at All County's discretion. This is a common practice in franchising, where advertising funds are often used for broad brand-building efforts rather than hyper-local campaigns.
