17.2.1. Expenditure of Advertising Fund. We may spend, on behalf of the Advertising Fund, in any fiscal year, an amount that is greater or less than the aggregate contribution of all ALL COUNTY® businesses to the Advertising Fund in that year and the Advertising Fund may borrow from us or others to cover deficits or invest any surplus for future use.
17.2.2. Interest Earned. All interest earned on monies contributed to the Advertising Fund will be used to pay advertising costs before other assets of the Advertising Fund are expended.
17.2.3. Reporting. We will prepare an annual compiled statement of monies collected and costs incurred by the Advertising Fund and furnish the statement to you upon written request.

What This Means (2025 FDD)
According to All County's 2025 Franchise Disclosure Document, All County has the flexibility to manage the Advertising Fund's expenditures. Specifically, All County may spend more or less than the total contributions received from all All County businesses in any given fiscal year. This means the company isn't strictly limited to spending only the exact amount collected in advertising fees during that year.
This flexibility allows All County to strategically manage the Advertising Fund. For example, if there's a particularly promising advertising opportunity that requires a larger investment, All County can tap into surplus funds from previous years or even borrow to cover the deficit. Conversely, if advertising needs are lower in a particular year, All County can invest the surplus for future use. This approach aims to optimize the impact of advertising efforts over time.
All County also states that all interest earned on the Advertising Fund will be used to pay advertising costs before other assets of the Advertising Fund are used. All County will provide an annual compiled statement of monies collected and costs incurred by the Advertising Fund, which will be furnished to franchisees upon written request. This provides a degree of transparency regarding the fund's financial activities. All County does not have any obligation to ensure that expenditures by the Advertising Fund in or affecting any geographic area are proportionate or equivalent to the contributions to the Advertising Fund by All County businesses operating in that geographic area, nor are they under any obligation to ensure that any All County business will benefit directly or in proportion to its Ad Fees paid to the Advertising Fund from the development of advertising and marketing materials or the placement of advertising.
