For Registration Numbers 5,637,568 and 6,042,000 above, the respective initial 10 year federal trademark registration periods have not elapsed yet but we intend to renew each of those Registrations when the respective renewal filing is due. |
You must follow our operating procedures when you use our trademarks and service marks (collectively "Marks"). You cannot use our Marks as part of your corporate name. You may not use our Marks in the event you wish to advertise the sale of your Franchise.
There are no currently effective material determinations of the PTO, Trademark Trial and Appeal Board, or the trademark administrator of any state or any court. There are no pending infringements, oppositions or cancellations concerning our principal Mark. There is no pending material litigation involving the principal Mark. There are no agreements currently in effect that significantly limit our rights to use or license the use of the principal Mark in a manner material to your ALL COUNTY® Franchise. We have submitted all required affidavits.
We have no actual knowledge of superior prior rights or infringing uses that could materially affect your use of the principal trademark in the state where your ALL COUNTY® Franchise may be located.

What This Means (2025 FDD)
According to All County's 2025 Franchise Disclosure Document, the registration date for trademark number 5,637,568 is December 25, 2018. This trademark is registered on the Principal Register. All County also states that the initial 10-year federal trademark registration period has not yet elapsed for this trademark, but they intend to renew the registration when the time comes.
Having a trademark registered on the Principal Register provides All County with certain legal rights. As a franchisee, you are required to follow All County's operating procedures when using their trademarks. You cannot use the trademarks as part of your corporate name or in advertisements for the sale of your franchise.
All County will protect franchisees from damages resulting from authorized trademark use, provided the franchisee complies with all agreements. All County has the sole right to manage any legal proceedings related to trademark infringement or challenges. Franchisees must immediately notify All County of any potential infringement or challenges to trademark use and must assist in protecting All County's trademark interests.
All County can modify or discontinue trademark use, and franchisees must comply with these changes. However, All County is not obligated to reimburse franchisees for any losses resulting from these changes or for expenses incurred in promoting modified or substitute trademarks.
