What This Means (2025 FDD)

According to All County's 2025 Franchise Disclosure Document, any disputes that proceed to arbitration will be administered by the American Arbitration Association (AAA). The AAA will use its Commercial Arbitration Rules that are in effect at the time, and the arbitration will be conducted by a single arbitrator.

Prior to initiating arbitration, All County requires that disputes undergo mediation. If mediation is unsuccessful within thirty days, either party can then pursue arbitration. The mediation process itself is confidential, with both parties sharing the costs of the mediator equally while covering their own individual expenses.

The arbitration proceedings will be governed by the Federal Arbitration Act. The arbitration must take place in the city closest to All County's headquarters at the time of the dispute. The arbitrator selected must have at least five years of experience in commercial law and is bound to follow the law and the terms of the franchise agreement. The arbitrator's powers are also limited, as they cannot, for example, stay the termination of the agreement or award punitive damages.
