Can the All County Methods of Operation regulate the use of Marks?

According to All County's 2025 Franchise Disclosure Document, the Methods of Operation can regulate the use and display of the Marks. The FDD defines "Marks" as the trade names, trademarks, service marks, and trade dress used to identify All County businesses and their services and products, including the "ALL COUNTY" mark. The "Methods of Operation" are the mandatory and suggested specifications, standards, operating procedures, and rules that All County prescribes for the operation of the franchised business.

All County's right to regulate the use of its Marks through its Methods of Operation ensures brand consistency and protects the goodwill associated with the All County name. This is a common practice in franchising, as it allows the franchisor to maintain uniform standards across all franchise locations.

As an All County franchisee, you do not have an ownership interest in the Marks and must use them as the sole identification of the business, while also identifying yourself as the independent owner in a prescribed manner. You must display the Marks prominently at the business, on designated supplies and materials, and in connection with forms, advertising, and marketing materials. You are restricted from using the Marks as part of any corporate or legal business name, internet domain name, email address, or with any unauthorized modifications, or in connection with unauthorized services or products, or in any manner not expressly authorized in writing by All County. Upon termination or expiration of the franchise agreement, you must discontinue all use of the Marks.
