Can other All County franchisees conduct other advertising inside my territory?

Except for conducting grass-roots marketing efforts in your Territory, defined as conducting direct mail campaigns or physically visiting real estate offices or other businesses in your Territory for the purposes of soliciting referrals, we, our affiliates, or other franchisees have the right to conduct radio, television, or other advertising, or service customer accounts inside your Territory. We have the right to sell services and any ancillary products, whether or not using the Marks, inside or outside your Territory through distribution channels other than ALL COUNTY® businesses, including offering real estate advertising and listing services through Internet websites or through published materials that are distributed in your Territory. We do not have to pay you any compensation for soliciting or accepting orders inside your Territory.

What This Means (2025 FDD)
According to All County's 2025 Franchise Disclosure Document, franchisees may face advertising from other franchisees within their territory. While All County will not allow other franchisees to conduct "grass-roots marketing efforts" such as direct mail campaigns or physically visiting businesses to solicit referrals, they do reserve the right for other franchisees to conduct radio, television, or other advertising within your territory. This means that while another franchisee cannot directly solicit businesses in your territory, their advertising may still reach potential customers in your area.
This could create competition for potential customers within your territory, as customers may be swayed by advertising from other All County franchisees. It is important to note that All County does not have to pay you any compensation for these activities. This is a fairly common practice in franchising, as franchisors often want to maximize brand awareness and reach as many potential customers as possible.
Furthermore, All County, its affiliates, or other franchisees have the right to conduct radio, television, or other advertising, or service customer accounts inside your Territory. All County also retains the right to sell services and any ancillary products, whether or not using the Marks, inside or outside your Territory through distribution channels other than All County businesses, including offering real estate advertising and listing services through Internet websites or through published materials that are distributed in your Territory. This could further intensify competition within your territory.
