Under what circumstances is an Aira Fitness franchisee allowed to make changes or alterations to the Pod?

According to the 2025 Aira Fitness Franchise Disclosure Document, franchisees have very limited ability to make changes to the Pod. The franchisee cannot change the location of the Pod or any part of it from the address without prior written consent from Franchisor's Affiliate. Additionally, all repairs, parts, supplies, accessories, equipment and devices furnished, affixed, or installed to or on the Pod become the property of Franchisor's Affiliate.

The lease agreement between the Aira Fitness franchisee and Pure Gym Equipment LLC (Franchisor's Affiliate) strictly controls the use and any modifications to the Pod. The franchisee is entitled to possess and use the Pod for their lawful business as long as no Event of Default has occurred. The FDD states that the Pod is considered personal property, regardless of whether it's affixed to real property.

The franchisee is essentially leasing the Pod and must adhere to the terms of the lease, which includes restrictions on alterations and relocation. Any changes to the Pod or its location require explicit written consent from Franchisor's Affiliate, reinforcing the franchisor's control over the physical structure and presentation of the Aira Fitness business. This is typical in franchising to maintain brand uniformity and quality control.
