- F. Period of Operation. Subject to any contrary requirements of state or local law, your Aira Fitness Business must be open to the public and operated 24 hours each day of the year. We also reserve the right to require a minimum number of staffed hours. Any variance from this provision must be authorized by us in writing. You acknowledge and agree that if your Aira Fitness Business is closed for a period of two (2) consecutive days or five (5) or more days in any 12-month period without our prior written consent, such closure constitutes your voluntary abandonment of the franchise and business and we have the right, in addition to other remedies provided for herein, to terminate this Agreement.
- G. Operating Procedures; Manual. You must adopt and use as your continuing operational routine the required standards, procedures, methods of operation and management and security systems described in our operations manual or other written directives, including, but not limited to, system newsletters or bulletins that may be sent to all franchisees from time to time (collectively, "Manual"). We will revise the Manual and these standards and
systems periodically to meet changing conditions of operation and we willsend outsystem newsletters and bulletins from time to time.
The Manual may be delivered to you by hard copy or through electronic access on a franchisee portal we maintain. The Manual at all times is our sole property. You must at all times treat the Manual, and the information it contains, as secret and confidential, and must use all reasonable efforts to maintain such information as secret and confidential. You will be required to sign a confidentiality agreement at the time of access. We may from time to time revise the contents of the Manual and you expressly agree to comply with each new or changed requirement. You acknowledge and agree that the Manual and other system communications may only be available on the Internet or other online or computer communications.
- H. Confidential Information. You may not, during the term of this Agreement or thereafter, communicate, divulge or use for the benefit of any other person or entity any Confidential Information, except to such employees as must have access to it in order to operate the Aira Fitness Business.

According to the 2025 Aira Fitness Franchise Disclosure Document, after opening an Aira Fitness business, franchisees must ensure that the business is open to the public and operated 24 hours each day of the year, subject to state and local laws. Aira Fitness also reserves the right to require a minimum number of staffed hours. Any deviation from these hours requires written authorization from Aira Fitness.
Furthermore, franchisees must adhere to the standards, procedures, methods of operation, management, and security systems detailed in the Aira Fitness operations manual, including any system newsletters or bulletins. The manual is Aira Fitness's property and must be treated as confidential. Franchisees must also comply with any revisions to the manual.
In addition, franchisees must maintain the building (both exterior and interior), equipment, fixtures, signage, and trade dress in accordance with Aira Fitness's requirements and schedules. This includes performing necessary maintenance and repairs within a specified timeframe after receiving an evaluation report. Franchisees are also required to modernize and/or replace items of trade dress or equipment as needed to conform to the standards of new Aira Fitness locations, including modernizing the business within five years and replacing all fitness equipment within three years of the agreement's effective date.
Finally, franchisees must secure and maintain all required licenses, permits, and certificates related to their Aira Fitness business. They must also participate in Aira Fitness's website and any intranet or extranet systems, paying a monthly website fee that shall not exceed $400.00. Franchisees are responsible for the safety and wellbeing of their employees and customers and must have appropriate security measures in place to protect customer and employee personal data.
