What This Means (2025 FDD)
According to the 2025 Aira Fitness Franchise Disclosure Document, making a material misrepresentation or omission in any report to Aira Fitness is an event of default that triggers immediate termination of the franchise agreement, with no opportunity to cure the default. This applies to misrepresentations made to Aira Fitness itself, not explicitly to the Franchisor's affiliate.
This means that if a prospective Aira Fitness franchisee provides false or misleading information during the application process or in any subsequent reports required by Aira Fitness, the franchisor has the right to terminate the franchise agreement immediately. This could include misstatements about financial background, business experience, or any other information requested by Aira Fitness.
It is important for prospective franchisees to ensure that all information provided to Aira Fitness is accurate and complete. Any inaccuracies, even if unintentional, could lead to the termination of the franchise agreement and the loss of the investment. Franchisees should carefully review all documents and reports before submitting them to Aira Fitness to avoid any potential issues.
While the excerpt specifies misrepresentations made directly to Aira Fitness, it does not explicitly address misrepresentations made to the Franchisor's affiliate. A prospective franchisee should seek clarification from Aira Fitness regarding whether misrepresentations to an affiliate would also constitute grounds for immediate termination.
