What This Means (2025 FDD)
According to Aira Fitness's 2025 Franchise Disclosure Document, franchisees must use their best efforts to aggressively promote and advertise their Aira Fitness Business in their local area. This includes participating in any local promotional programs that Aira Fitness establishes, subject to applicable law.
In addition to participating in local promotional programs, Aira Fitness requires franchisees to spend at least $400 per month on local advertising. Any marketing material not designed or provided by Aira Fitness must be pre-approved. Franchisees must submit their marketing materials for approval prior to use, whether print, electronic, or other forms of media. Aira Fitness will not unreasonably withhold approval of marketing materials if they are factually accurate and current, dignified, up-to-date, and in good condition, adhere to brand standards, and accurately depict the Aira Fitness Marks. If Aira Fitness does not disapprove or comment within 10 business days of receipt, the marketing materials will be deemed approved.
Aira Fitness also has the right to designate geographical areas with at least two Aira Fitness franchises as "designated advertising areas" for establishing a Local Marketing Fund controlled by Aira Fitness or a local or regional advertising cooperative controlled by its members. If a Local Marketing Fund or Cooperative is established in the franchisee's market, the franchisee will be required to participate and contribute. These contributions are in addition to, and not in lieu of, the National Marketing Fee. The franchisor determines the contribution amount, but aggregate monthly contributions will not exceed $200 per month, subject to Consumer Price Index adjustments, unless a 2/3 vote of the Cooperative members approves a higher fee.
Each Cooperative must adopt governing bylaws that meet Aira Fitness's approval, and Aira Fitness will provide a sample form of bylaws. Aira Fitness reserves the right to administer the Cooperatives' funds and require payment from its members via electronic funds transfer. Aira Fitness also has the right to require Cooperatives to be formed, changed, dissolved, or merged.
