What This Means (2025 FDD)
According to Aira Fitness's 2025 Franchise Disclosure Document, certain locations are considered 'Special Sites' and are excluded from a franchisee's designated area. Aira Fitness retains the right to develop, license, or franchise Aira Fitness businesses at these locations, even within a franchisee's designated area. This means that while a franchisee may have a designated area where Aira Fitness will not establish another franchised location, this protection does not extend to these 'Special Sites'.
Examples of 'Special Sites' include military bases, public transportation facilities such as airports, railway stations, limited access highway travel plazas and other transportation terminals, and sports facilities, including race tracks. Additional examples of 'Special Sites' are student unions or similar buildings on college or university campuses, hotels, resorts or similar short-term lodging, apartment or condominium complexes, and corporate office buildings or office parks.
This provision is important for prospective franchisees to understand, as it means that Aira Fitness can establish additional locations that may compete with a franchisee's business within what might otherwise be considered their protected territory. Franchisees should consider the potential impact of these 'Special Sites' on their business when evaluating a franchise opportunity with Aira Fitness and choosing a location. It is also important to note that Aira Fitness and its affiliates have the right to develop and operate businesses offering fitness services under a different trademark within and outside the Designated Area, which may be similar to or competitive with Aira Fitness Businesses.
