What This Means (2025 FDD)

According to Aira Fitness's 2025 Franchise Disclosure Document, when a franchisee's lease expires or terminates early, they must return the Pod to the Franchisor's Affiliate. The franchisee is responsible for the risk and expense of assembling, preparing for shipment, and returning the Pod to a location designated by the Franchisor's Affiliate.

The key requirement is that the returned Pod must be in good condition, repair, and working order. The only exception to this is ordinary wear and tear, which is expected. This means that franchisees are responsible for maintaining the Pod in good working order throughout the lease term, as detailed in other sections of the FDD.

This requirement protects the value of the Pod for the Franchisor's Affiliate, ensuring it can be re-leased or otherwise utilized after the initial franchisee's term. Franchisees should be aware of this obligation and factor in maintenance and repair costs to keep the Pod in acceptable condition, as any significant damage beyond normal wear and tear could lead to disputes or additional charges upon return.
