What This Means (2024 FDD)
According to Afuri Ramen Dumpling's 2024 Franchise Disclosure Document, Afuri Ramen Dumpling does not post job openings for franchisee locations on their website. The FDD clarifies that franchisees are responsible for hiring, firing, scheduling, directing, supervising, and disciplining their own employees, as well as setting wages and working conditions. Afuri Ramen Dumpling also does not coordinate the sharing of employees among different franchise locations.
This means that as an Afuri Ramen Dumpling franchisee, you will have complete control over your employees and contractors. You are responsible for maintaining employee records, complying with federal and state labor laws, and handling all employee wages, compensation, payroll taxes, worker's compensation, and benefits. You must also indemnify Afuri Ramen Dumpling from any violations of labor laws.
To ensure clarity, Afuri Ramen Dumpling requires franchisees to include a statement on employee applications indicating that applicants are applying to work for the franchisee, not Afuri Ramen Dumpling. Additionally, payroll checks must display the franchisee's entire business entity name, not just the licensed brand. Franchisees are also responsible for developing their own employee handbooks using independent sources.
This policy reflects the independent contractor relationship between Afuri Ramen Dumpling and its franchisees, where franchisees are responsible for the day-to-day operations of their individual businesses, including all staffing matters. This arrangement is typical in many franchise systems, where the franchisor sets brand standards and provides operational guidance, but the franchisee manages their own employees.
