What This Means (2024 FDD)
According to the 2024 Afuri Ramen Dumpling Franchise Disclosure Document, Afuri Ramen Dumpling does not post job openings for franchise locations on their website. As an Afuri Ramen Dumpling franchisee, you are responsible for hiring, firing, scheduling, directing, supervising, and disciplining your own employees. You also set their wages and working conditions.
Afuri Ramen Dumpling franchisees must maintain employee records that clearly show that the franchisee and their employees are not employees of Afuri Ramen Dumpling. Franchisees must also comply with federal and state labor laws, including wage and hour laws, and are responsible for employee wages, compensation, payroll taxes, worker's compensation, and benefits.
To further clarify the independent nature of the franchisee's business, Afuri Ramen Dumpling requires franchisees to include a prominent statement on employee applications indicating that the applicant is applying to work for the franchisee, not Afuri Ramen Dumpling. Additionally, payroll checks must display the franchisee's entire business entity name, not just the licensed Afuri Ramen Dumpling brand. Afuri Ramen Dumpling also does not coordinate the sharing of employees among franchisees or provide sample employee handbooks.
