What This Means (2024 FDD)
According to Afuri Ramen Dumpling's 2024 Franchise Disclosure Document, all data pertaining to the franchise, including customer data and data collected or created in connection with the operation of the franchise, is considered "Afuri Data" and is the sole property of Afuri Franchise Inc.
This means that while the franchisee collects and uses this data, Afuri Ramen Dumpling retains ownership and has the right to review and use the data in any manner they deem appropriate, without providing any compensation to the franchisee. The franchisee is required to provide copies or originals of the Afuri Data within five days of the franchisor's request, at no cost to the franchisor, both during the term of the Franchise Agreement and upon its expiration or termination.
The franchisee is granted a license to use the Afuri Data during the term of the Franchise Agreement, at no cost, but solely for the operation of their franchise. The franchisee must keep the Afuri Data secret and confidential and cannot make it available to any unauthorized person without the franchisor's prior written consent, and even then, only in the manner permitted by Afuri Ramen Dumpling.
This arrangement is common in franchising, allowing the franchisor to maintain control over valuable data related to the brand and customer base. It enables Afuri Ramen Dumpling to analyze trends, understand customer preferences, and make informed decisions to benefit the entire franchise system. However, it also means that the franchisee does not have independent ownership or control over the data they collect, which could limit their ability to use it for purposes outside the scope of the franchise agreement.
