What This Means (2024 FDD)
According to Afuri Ramen Dumpling's 2024 Franchise Disclosure Document, Afuri Ramen Dumpling does not assume liability for the selection or approval of any location or lease for the franchise premises. While Afuri Ramen Dumpling may offer site selection assistance, the franchisee is ultimately responsible for ensuring the chosen site meets the brand's minimum requirements as outlined in the operations manual.
Before a franchisee enters into a lease or purchase agreement, the documents must be submitted to Afuri Ramen Dumpling for approval. Lease documents must include a Franchise Premises Lease Agreement Rider or an assignment of the lease in a form approved by Afuri Ramen Dumpling, allowing them to assume the lease under certain conditions. The franchisee must provide Afuri Ramen Dumpling with a copy of the lease and any amendments promptly after execution.
This means that while Afuri Ramen Dumpling sets minimum criteria and may provide guidance, the final decision on the location and lease rests with the franchisee. The franchisee bears the responsibility of assessing the suitability and desirability of the lease terms. This arrangement is typical in franchising, where franchisees are independent business owners who make their own location and contractual decisions, with franchisors providing brand standards and support rather than guarantees.
