    1. Upon 30 days' notice from us that we have established the System Media Fund, you must contribute to the System Media Fund in the manner we specify. All sums you pay to the System Media Fund will be maintained in an account separate from our other monies.

According to Aerus's 2025 Franchise Disclosure Document, all sums paid to the System Media Fund by franchisees will be maintained in an account separate from Aerus's other monies. This fund is intended to enhance the image of Aerus's programs through various advertising, marketing, and public relations activities. Aerus or its designee has the right to direct all advertising programs and aspects of the System Media Fund.

The System Media Fund will cover costs related to advertising campaigns, social media, direct mail, marketing surveys, promotional items, and more. Aerus can also use the fund to offset costs associated with creative development, production, and salaries of employees involved in system marketing activities. Franchisees are required to contribute to the fund as specified by Aerus, starting 30 days after notice of its establishment.

Aerus retains the right to charge the System Media Fund for reasonable administrative costs and overhead related to the fund's direction and implementation. While the fund's earnings will not directly benefit Aerus or be used to solicit franchise sales, Aerus will provide an annual statement of the fund's operations, which may or may not be audited, to franchisees upon written request. Although the System Media Fund is intended to be perpetual, Aerus reserves the right to terminate it once all monies have been spent on marketing or promotional purposes.
