- During the Term of the Franchise Agreement, you must actively and diligently maintain, use, update, correct and supplement the Customer Data. You must update the Customer Data immediately upon completion of any sale or customer contact, must regularly review the Customer Data and take such action as may be appropriate based on the Customer Data, and must otherwise use the Customer Data for marketing, lead generation, sales and recruiting purposes in accordance with the System and our procedures concerning such activities. You must not use the Customer Data, or permit the Customer Data to be used, for any purpose except the operation of the Franchised Business.

According to Aerus's 2025 Franchise Disclosure Document, franchisees must actively maintain, use, update, correct, and supplement the Customer Data during the term of the Franchise Agreement. This includes updating the Customer Data immediately after any sale or customer contact. Aerus franchisees must regularly review the Customer Data and take appropriate action based on it.
Aerus requires that franchisees use the Customer Data for specific purposes related to the operation of the franchised business. These purposes include marketing, lead generation, sales, and recruiting, all in accordance with the Aerus system and procedures. Franchisees are explicitly prohibited from using the Customer Data for any other purpose outside the operation of the Franchised Business.
Aerus retains all rights to the Customer Data not expressly granted to the franchisee in the Franchise Agreement. This includes the right to terminate a franchisee's access to the Customer Data, grant licenses to others, and use the data for its own distribution and sales of products and services. This highlights that the franchisee's access to and use of the Customer Data is limited and subject to Aerus's control and ownership.
