What This Means (2025 FDD)
Based on the 2025 Aerus Franchise Disclosure Document, Aerus itself does not have explicit legal obligations directly to the Outlet Licensees of its franchisees. However, the franchisee has obligations regarding their Outlet Licensees.
Specifically, the franchisee must fulfill all promises and commitments made to Approved Customers by the franchisee and any of its Outlet Licensees, Sales Representatives, employees, or agents. This means Aerus franchisees are responsible for ensuring that their Outlet Licensees honor commitments to customers.
Additionally, the termination of a Franchise Agreement between Aerus and a franchisee automatically terminates any licenses and agreements the franchisee has with its Outlet Licensees and Sales Representatives. This highlights that the Outlet Licensees' rights are tied to the franchisee's agreement with Aerus, not directly with Aerus itself. Therefore, a prospective franchisee should understand that their agreements with Outlet Licensees are contingent upon their own franchise agreement with Aerus.
