We or our affiliate offer certain warranties in connection with Consigned Products for the benefit of Approved Customers (the "Franchisor Consumer Warranties"). Neither you, nor any of your Outlet Licensees or sales representatives, may represent or suggest that we or our affiliate have or will provide any warranty, express or implied, other than the Franchisor Consumer Warranty. You may not extend the Franchisor Consumer Warranty or provide or offer additional warranties above and beyond the Franchisor Consumer Warranty. You must honor and provide service in connection with any Franchisor Consumer Warranty. Under the Associate Program, if you are not required to maintain a service and repair center at your Approved Location, your obligations to provide service in connection with any Franchisor Consumer Warranty must be met by entering into a contractual arrangement (approved by us) with an existing owner of an Aerus Business.

What This Means (2025 FDD)
According to Aerus's 2025 Franchise Disclosure Document, franchisees are strictly limited in the types of warranties they can offer. Aerus or its affiliate provides certain warranties for the benefit of approved customers, referred to as the "Franchisor Consumer Warranties." Franchisees, their Outlet Licensees, and sales representatives are only allowed to represent or suggest that Aerus will provide the Franchisor Consumer Warranty.
Aerus franchisees are prohibited from representing or suggesting any warranty beyond the Franchisor Consumer Warranty, whether express or implied. They cannot extend the Franchisor Consumer Warranty or offer additional warranties that go above and beyond what Aerus provides. However, franchisees are obligated to honor and provide service in connection with the Franchisor Consumer Warranty.
Under the Associate Program, if a franchisee is not required to maintain a service and repair center at their Approved Location, they must still fulfill their service obligations related to the Franchisor Consumer Warranty. This can be achieved by entering into a contractual arrangement, approved by Aerus, with an existing owner of an Aerus Business. This ensures that all warranty service requirements are met, even if the franchisee does not have an on-site service center.
Aerus also requires approval of all forms of sales contracts, warranties, and service contracts before they are offered to customers. Franchisees may not modify or alter approved forms without prior written consent from Aerus. This ensures consistency and compliance with Aerus's standards across all franchise locations.
