What This Means (2025 FDD)

According to Aerus's 2025 Franchise Disclosure Document, upon the expiration or termination of the Franchise Agreement, all rights and licenses granted to the franchisee concerning the Customer Data automatically terminate. The franchisee is then required to promptly return to Aerus any printed or virtual material containing the Customer Data. Aerus retains all rights to and goodwill in the Customer Data, and the agreement does not grant the franchisee any rights to the Customer Data beyond what is specifically outlined in the agreement.

This means that when an Aerus franchise agreement ends, the franchisee loses the right to use the customer database they may have been using during the term of the agreement. They must also hand over all physical and digital records of this data back to Aerus. This is a standard practice in franchising, as the customer data is considered a valuable asset of the franchisor.

For a prospective Aerus franchisee, this underscores the importance of building a sustainable business during the franchise term. Since the customer data reverts back to Aerus, the franchisee cannot rely on it to continue operations independently after the agreement expires or is terminated. This highlights the need to focus on strategies for customer retention and building brand loyalty within the community to ensure a business can continue even without access to the franchisor's database.
