Aerus Franchise · 2025 FDD

Answer from 2025 FDD Document

The Marks may be used only in the United States if your Approved Locations are in the United States and only in Canada if your Approved Locations are in Canada, and only in (i) direct retail sales to residential customers (meaning door-to-door sales and other sales to residential end-users in a manner other than from a fixed store location open to the general public but not including sales over the Internet or other electronic communications media); and (ii) retail sales to consumers from facilities owned or leased by us or our franchisee and identified as "Aerus" and/or "Electrolux" stores, provided such facilities offer for resale to the general public, in substantial part, only those products sold under the "Aerus" and "Electrolux" brands.

What This Means (2025 FDD)

According to Aerus's 2025 Franchise Disclosure Document, franchisees are permitted to use the "Electrolux" and "Lux" marks only in specific geographic locations and under certain conditions. Aerus franchisees can use these marks in the United States if their approved locations are in the United States, and in Canada if their approved locations are in Canada. This usage is restricted to (i) direct retail sales to residential customers, which includes door-to-door sales and other sales to residential end-users that do not occur from a fixed store location open to the general public, excluding online sales, and (ii) retail sales to consumers from facilities owned or leased by Aerus or its franchisees, identified as "Aerus" and/or "Electrolux" stores, provided these facilities primarily offer products sold under the "Aerus" and "Electrolux" brands.

This means that an Aerus franchisee's ability to use the "Electrolux" and "Lux" trademarks is limited by their physical location and sales methods. They cannot use the marks for online sales or in general retail locations. This restriction ensures that the trademarks are used in a manner consistent with Aerus's brand strategy and quality standards.

Prospective franchisees should be aware that failure to comply with these trademark usage guidelines could result in the termination or suspension of their license to use the marks. Additionally, franchisees are obligated to assist in protecting the marks and must indemnify Aerus and its affiliates against any claims resulting from their use of the marks on products or materials. This underscores the importance of adhering to Aerus's trademark policies to maintain the integrity of the brand and avoid potential legal issues.
