Franchisee shall do such acts or things, as may, in Company's reasonable opinion, be necessary or advisable to protect and monitor the integrity of the Customer Data.

Franchisee acknowledges the value of the Customer Data and agrees that a substantial element of the System and function of the Franchised Business is support, service and development of Company's customer relationships.

To that end, during the Term of this Agreement, Franchisee shall actively and diligently maintain, use, update, correct and supplement the Customer Data.

Franchisee shall update the Customer Data immediately upon completion of any sale or customer contact, shall regularly review the Customer Data and take such action as may be appropriate based on the Customer Data, and shall otherwise use the Customer Data for marketing, lead generation, sales and recruiting purposes in accordance with the System and Company's procedures concerning such activities.

Franchisee shall not use the Customer Data, or permit the Customer Data to be used, for any purpose except the operation of the Franchised Business and all uses and purposes incidental thereto.

According to Aerus's 2025 Franchise Disclosure Document, franchisees must perform actions deemed necessary or advisable by Aerus to protect and monitor the integrity of the Customer Data. Aerus owns and maintains a database of customer information referred to as the "Customer Data." Aerus may allow franchisees to use the portion of the Customer Data relevant to their Area of Responsibility, provided the franchisee pays the Customer Data Fee and strictly complies with the terms and conditions outlined in the Franchise Agreement, Policies and Procedures, and any specific guidelines Aerus may impose regarding the collection, maintenance, and use of the Customer Data.

During the term of the agreement, Aerus franchisees are required to actively and diligently maintain, use, update, correct, and supplement the Customer Data. This includes updating the Customer Data immediately after any sale or customer contact, regularly reviewing the Customer Data, and taking appropriate actions based on the data. Franchisees must also use the Customer Data for marketing, lead generation, sales, and recruiting purposes in accordance with the Aerus system and procedures.

Aerus franchisees are explicitly prohibited from using the Customer Data for any purpose other than operating the franchised business and related activities. Upon expiration or termination of the Franchise Agreement, all rights and licenses to the Customer Data automatically terminate, and the franchisee must promptly return any printed or virtual materials containing the Customer Data to Aerus. All rights to and goodwill in the Customer Data remain the sole and exclusive property of Aerus, and franchisees are prohibited from challenging Aerus's rights to the Customer Data.
