Franchisee shall implement and use all functions of FOAS in the operation, administration, management and control of the Franchised Business and shall adopt for use all new programs and modules developed and installed from time to time by Company, including without limitation the Franchise Accounting Systems and Tools program module (including any successor or substitute financial management program or module which may be developed, "FAST"), and, if applicable, pay any fee imposed for the new program or module.

What This Means (2025 FDD)
According to Aerus's 2025 Franchise Disclosure Document, franchisees are required to use all functions of the Aerus Franchise Office Automation System (FOAS) in their business operations. FOAS is described as a proprietary computer information and office automation system developed by Aerus and its affiliates. It includes various software programs and modules for customer relationship and lead management, financial administration, and inventory management.
To support FOAS, franchisees must own and maintain computer hardware, facilities, and internet connections that meet the minimum performance specifications set by Aerus. Franchisees must also allow Aerus or its affiliates to access their computer equipment for installing, updating, and supporting FOAS. They must follow Aerus's instructions related to the installation, updates, and support of the system.
In addition to using all functions of FOAS, Aerus franchisees must adopt any new programs and modules developed and installed by Aerus, including the Franchise Accounting Systems and Tools program module (FAST). Franchisees may also be required to pay a fee for these new programs or modules. Furthermore, franchisees are required to execute a Software License Agreement, the form of which is attached as Exhibit II to the Franchise Disclosure Document.
