What This Means (2025 FDD)

According to Aerus's 2025 Franchise Disclosure Document, the definitions of capitalized terms and phrases used in the Standard Program Franchise Agreement are located in Addendum A, which is attached to the agreement and incorporated by reference. This means that when reviewing the franchise agreement, franchisees should refer to Addendum A to understand the specific meanings of terms like "Agreement," "Effective Date," "Company," and "Franchisee" as they are used within the legal document.

Understanding these definitions is crucial because they establish the precise legal meanings of key terms that dictate the rights and obligations of both Aerus and the franchisee. For example, the definition of "Franchisee" clarifies who exactly is bound by the agreement (e.g., an individual or a business entity). Similarly, the "Effective Date" determines when the agreement officially comes into force, which can trigger various deadlines and responsibilities.

By incorporating Addendum A into the franchise agreement, Aerus ensures that all parties have a common understanding of the terminology used. Franchisees should carefully review Addendum A alongside the main body of the franchise agreement to avoid any potential misunderstandings or disputes. Paying close attention to these definitions is a standard practice in franchising, as it helps to clarify the contractual relationship and protect the interests of both parties.
