What This Means (2025 FDD)
According to Aerus's 2025 Franchise Disclosure Document, Aerus grants franchisees a protected area. Except as provided in the franchise agreement, Aerus will not establish, permit, or authorize any other person or entity to establish a physical location for an Aerus business under any of the four programs listed in Recital C within the area identified as the Protected Area in Schedule 1.
The franchisee's right to offer and sell products is limited to Approved Customers within the Area of Responsibility, as defined in Schedule 1. These sales are generally made through the Approved Location or via in-home or in-person demonstrations within the Area of Responsibility. However, this does not grant the right to offer and sell Beyond Products.
It's important to note that Aerus and its affiliates can operate existing businesses and systems, and may establish new ones, including Aerus businesses, under similar names and trademarks. These businesses may offer similar products and services within any part of the Area of Responsibility, except as limited by the rights granted to the franchisee in the agreement. The franchise agreement specifies that the franchisee cannot sell to individuals outside their designated Area of Responsibility or conduct business over the internet without the company's explicit approval. The exact size and boundaries of the protected area and area of responsibility are defined in Schedule 1 of the Franchise Agreement, which is not included in this excerpt.
