According to Aerus's 2025 Franchise Disclosure Document, an 'Approved Location' refers to the location or locations of the Franchised Business that are identified on Schedule 1 of the agreement. Any other location must be subsequently approved and permitted by Aerus in writing.
Aerus franchisees are required to operate their Franchised Business from one or more Approved Locations and from no other physical location, unless Aerus permits otherwise in writing at its sole option. This means that franchisees cannot operate from unapproved locations without explicit written consent from Aerus.
Furthermore, Aerus requires that any premises lease covering an Approved Location includes a lease rider in a form substantially similar to the form attached to the Franchise Agreement as Exhibit I. This likely ensures that the lease terms align with Aerus's requirements and protects their interests in the location. Franchisees must also establish and maintain a service and repair center at the Approved Location, in accordance with the manuals, to provide care and service to Approved Customers. However, in limited circumstances, with Aerus's prior approval, a franchisee may satisfy this obligation by entering into a contractual arrangement with an existing owner of an Aerus Business to discharge and perform all the franchisee's repair, maintenance, service, and warranty obligations.
