What This Means (2025 FDD)
According to Aerus's 2025 Franchise Disclosure Document, maintaining customer data is a crucial responsibility for franchisees. Aerus retains ownership of the Customer Data, but franchisees are granted limited access to it within their designated Area of Responsibility. To properly maintain this data, franchisees must actively and diligently update, correct, and supplement the Customer Data throughout the term of the Franchise Agreement. This includes updating the data immediately after any sale or customer contact.
Aerus franchisees are also required to regularly review the Customer Data and take appropriate actions based on the information it contains. This involves using the Customer Data for marketing, lead generation, sales, and recruiting purposes, all in accordance with the Aerus system and its established procedures. It is explicitly stated that franchisees cannot use the Customer Data for any purpose outside the operation of their Franchised Business.
Aerus also retains significant rights regarding the Customer Data. They can terminate a franchisee's access to the data, grant licenses to others for its use (even within the franchisee's Area of Responsibility), develop systems for managing the data, and use the data for their own sales and distribution activities. This highlights the importance of adhering to Aerus's guidelines for Customer Data management, as failure to do so could impact a franchisee's access to this valuable resource.
