What This Means (2023 FDD)

According to the 2023 Franchise Disclosure Document, Advanced Mobile Iv And Amiv can terminate the franchise agreement under several conditions. These include failing to administer the minimum number of IVs or achieve the minimum gross sales outlined in the Performance Benchmarks, which are detailed in Schedule 4 of the Franchise Agreement. This benchmark ensures franchisees maintain a certain level of business activity and revenue generation.

Additionally, Advanced Mobile Iv And Amiv may terminate the agreement if a franchisee fails to operate in accordance with local licensing, practice, or layperson-influence rules, or if the operation of the franchise poses an imminent danger to public health or safety. This emphasizes the importance of adhering to regulatory standards and maintaining a safe environment for clients. Breaching confidentiality by disclosing Confidential Information (except to authorized employees) or failing to secure confidentiality agreements from employees also constitutes grounds for termination.

Further, Advanced Mobile Iv And Amiv can terminate the agreement if the franchisee attempts to repudiate the agreement or demonstrates an intention to no longer comply with its terms. The agreement also states that if the franchisee becomes insolvent, makes an assignment for the benefit of creditors, has a receiver appointed, admits inability to meet obligations, or becomes bankrupt, it can lead to immediate termination without an opportunity to cure the breach. Advanced Mobile Iv And Amiv may also limit or shut down a franchisee's access to forms, software, websites, or continued operation if they fail to make timely payments of Royalty Fees, Marketing Fees, or other fees, or otherwise breach the agreement.
