What This Means (2023 FDD)

According to Advanced Mobile Iv And Amiv's 2023 Franchise Disclosure Document, the non-compete agreement does apply to the franchisee's owners. The agreement explicitly states that 'you and your owners' are subject to the non-compete terms upon termination, expiration, or transfer of the franchise agreement. This means that not only the franchisee but also individuals with ownership stakes in the franchise are restricted from engaging in competitive activities.

The non-compete covenant extends for 720 days following the termination, expiration, or transfer of the agreement. During this period, franchisees and their owners are prohibited from participating in any business involved in offering, selling, or promoting intravenous therapies and hydration services or products that are essentially the same or substantially similar to the Licensed Methods of Advanced Mobile IV And Amiv. This restriction covers a broad range of activities, including being an owner, shareholder, director, partner, officer, employee, consultant, franchisor, franchisee, distributor, advisor, or agent in a competing business.

The geographic scope of the non-compete agreement includes the Franchise Territory, within 25 miles of the Franchise Territory, within 25 miles of any market area where Advanced Mobile IV And Amiv operates or has granted a franchise, and within the entire United States of America. This broad geographic restriction highlights the importance Advanced Mobile IV And Amiv places on protecting its market and business model. Prospective franchisees and their owners should carefully consider these non-compete terms and their implications before entering into a franchise agreement, as they could significantly limit future business opportunities in the specified industry and locations.
