What This Means (2023 FDD)
According to Advanced Mobile Iv And Amiv's 2023 Franchise Disclosure Document, the MSO's administrative personnel are entitled to breaks as required by applicable laws or regulations. The document states that nothing in the agreement should be interpreted to obligate the MSO to violate any employment laws or regulations. The MSO is responsible for recruiting, training, supervising, hiring, and firing its administrative personnel, as well as handling any necessary disciplinary actions.
This means that as a franchisee, you will not be responsible for ensuring that the administrative staff employed by the MSO receive their legally mandated breaks. This responsibility falls solely on the MSO. This arrangement helps to ensure compliance with labor laws and reduces the administrative burden on the franchisee.
Prospective franchisees should be aware of this division of responsibility, as it clarifies the roles of both the franchisee and the MSO in managing personnel and adhering to legal requirements. Understanding these obligations is crucial for the smooth operation of the franchise and for maintaining compliance with employment laws.
