What This Means (2023 FDD)
According to Advanced Mobile Iv And Amiv's 2023 Franchise Disclosure Document, a transferee acquiring an existing franchise must execute all documents that Advanced Mobile Iv And Amiv then requires of new franchisees. This explicitly includes a new franchise agreement, which may have materially different economic and general terms from the original agreement. The term of the new agreement will be for the unexpired term of the original agreement or for a new full term, as Advanced Mobile Iv And Amiv elects.
This requirement ensures that all franchisees operate under the most current terms and conditions established by Advanced Mobile Iv And Amiv. It also allows Advanced Mobile Iv And Amiv to update the franchise agreement to reflect changes in the market, legal requirements, or the company's business practices. The transferee must also meet Advanced Mobile Iv And Amiv's standards for quality of character, financial capacity, and experience required of a new or renewing franchisee.
For a prospective transferee, this means being prepared to agree to potentially different terms than the original franchisee. It is crucial to carefully review the new franchise agreement and understand any changes to fees, royalties, operational requirements, or other key aspects of the franchise. The transferee should also be prepared to meet Advanced Mobile Iv And Amiv's standards for new franchisees, which may include demonstrating sufficient financial resources, relevant experience, and a commitment to operating the franchise in accordance with Advanced Mobile Iv And Amiv's standards.
Additionally, the original franchisee is responsible for providing the prospective purchaser with Advanced Mobile Iv And Amiv's current form of disclosure document required by applicable federal or state registration and disclosure laws, and a receipt for this document will be delivered to Advanced Mobile Iv And Amiv. However, Advanced Mobile Iv And Amiv will not be liable for any representations the original franchisee makes apart from those contained in their disclosure document.
