What This Means (2023 FDD)
According to the 2023 Franchise Disclosure Document, Advanced Mobile Iv And Amiv must provide the Franchise Disclosure Document (FDD) to prospective franchisees at the earliest of two conditions. First, if the prospective franchisee is in New York, the FDD must be provided at the first personal meeting to discuss the franchise. Second, in all other states excluding Michigan and New York, the FDD must be provided 14 calendar days before signing a binding agreement or making any payment to Advanced Mobile Iv And Amiv or its affiliates related to the franchise sale. In Michigan and New York, this period is shortened to 10 business days.
This regulation ensures that potential franchisees have adequate time to review the FDD and make informed decisions. The FDD contains critical information about the franchise system, including fees, obligations, and financial performance. By mandating a waiting period, franchise laws aim to protect franchisees from high-pressure sales tactics and ensure they have sufficient opportunity to seek legal and financial advice.
It is important for prospective Advanced Mobile Iv And Amiv franchisees to note these deadlines and ensure they receive the FDD in a timely manner. If Advanced Mobile Iv And Amiv fails to deliver the FDD on time or if the document contains false, misleading, or omits material information, it may constitute a violation of federal and state laws. In such cases, the franchisee should report the violation to the Federal Trade Commission and the relevant state agency.
