does not have many legal benefits and rights as a federally registered trademark. If our right to use the trademark is challenged, you may have to change to an alternative trademark, which may increase your expenses.

We and our affiliates also claim common law rights to the "AMIV" and "ADVANCED MOBILE IV" names, marks and logos, including the following logos:

We will allow you to use these and all other trade names, trademarks, service marks, and logos we now own or may in the future develop for our franchise system. We refer to all these commercial symbols as the "trademarks."

What This Means (2023 FDD)

According to Advanced Mobile Iv And Amiv's 2023 Franchise Disclosure Document, Advanced Mobile Iv And Amiv and its affiliates assert common law rights to the "AMIV" and "ADVANCED MOBILE IV" names, marks, and logos. This claim extends to any other marks used by them in interstate commerce within the United States, based on the widespread use of these names in interstate commerce.

For a prospective franchisee, this means that while Advanced Mobile Iv And Amiv has registered the 'Advanced Mobile IV' word mark on the Supplemental Register, they also rely on common law rights for their trademarks. Common law rights arise from the actual use of a trademark in commerce, regardless of whether the mark is formally registered. However, these rights are generally limited to the geographic area where the mark has been used and recognized. This is particularly relevant considering Advanced Mobile Iv And Amiv is aware of a business in Arizona operating under similar names, which could affect a franchisee's rights, especially if they plan to operate in Arizona.

The FDD also states that Advanced Mobile Iv And Amiv will allow franchisees to use all trade names, trademarks, service marks, and logos they own or may develop in the future. However, franchisees must adhere to Advanced Mobile Iv And Amiv's rules for trademark use and must notify Advanced Mobile Iv And Amiv of any infringement or challenges to the trademarks. Advanced Mobile Iv And Amiv retains sole discretion in deciding whether to take action on such infringements or challenges and is not obligated to protect a franchisee's right to use the trademarks or defend them against claims of infringement.

It is important for potential franchisees to understand the implications of Advanced Mobile Iv And Amiv's reliance on common law rights, especially in areas where similar businesses operate. Franchisees should also be aware that Advanced Mobile Iv And Amiv has the right to modify the trademarks at their discretion, and franchisees will bear any costs associated with these changes. Furthermore, all goodwill associated with the trademarks accrues to Advanced Mobile Iv And Amiv, except as otherwise provided by applicable law.
