We need not protect or defend copyrights, although we intend to do so if in the system's best interests. We have the right to control any action we choose to bring, even if you voluntarily bring the matter to our attention. You must follow any instructions we give you. What This Means (2025 FDD)

According to 7 Brew's 2025 Franchise Disclosure Document, 7 Brew is not required to participate in a franchisee's defense or indemnify them for damages or expenses incurred in a copyright proceeding. While 7 Brew claims copyrights in various materials such as the Operations Manual, store blueprints, signage, and marketing materials, they are not obligated to provide legal or financial assistance to franchisees in copyright-related legal matters. However, 7 Brew states that they intend to protect and defend their copyrights if it is in the best interest of the 7 Brew system. If a franchisee brings a copyright matter to 7 Brew's attention, 7 Brew retains the right to control any action related to it, and the franchisee must follow any instructions given by 7 Brew.

This means that if a franchisee is sued for copyright infringement related to the operation of their 7 Brew store, they will be responsible for their own legal defense and any associated costs. This is a potential risk for franchisees, as copyright litigation can be expensive and time-consuming. It is important for prospective franchisees to understand this aspect of the franchise agreement and to consider obtaining their own legal counsel and insurance to protect themselves against such risks.

In the franchise industry, it is not uncommon for franchisors to retain control over intellectual property defense, as they have a vested interest in protecting their brand and system. However, the extent of support provided to franchisees in such matters can vary. Some franchisors may offer more comprehensive support, including legal representation and indemnification, while others may take a more hands-off approach, as 7 Brew does. Prospective franchisees should carefully review the franchise agreement and consider the level of support offered by the franchisor in intellectual property matters before investing in a franchise.
