You must open all of the Traditional 7 BREW Stores in compliance with the Schedule, provided, however, that we are not obligated to execute any franchise agreement contemplated by this Rider if you have not complied with each and every condition in this Rider or otherwise do not meet our then-current requirements.

What This Means (2025 FDD)

According to the 2025 7 Brew Franchise Disclosure Document, 7 Brew is not obligated to execute any franchise agreement contemplated by the Rider if the franchisee has not complied with each and every condition outlined in the Rider or does not meet 7 Brew's then-current requirements. This stipulation underscores the importance of strict adherence to the terms and conditions set forth in the Rider.

For a prospective 7 Brew franchisee, this means that failing to meet any condition, no matter how small it might seem, could jeopardize the entire franchise agreement. This could include missing deadlines, failing to meet specific operational standards, or not adhering to financial requirements. The phrase "then-current requirements" also suggests that 7 Brew can change its requirements during the term of the Rider, and franchisees must meet those new requirements as well.

This provision protects 7 Brew by ensuring that only qualified and compliant franchisees are brought into the system. However, it also places a significant burden on the franchisee to meticulously follow all guidelines and requirements. A prospective franchisee should carefully review the Rider and seek legal counsel to fully understand their obligations and the potential consequences of non-compliance. They should also inquire about what 7 Brew's 'then-current requirements' are and how frequently they change.
