Can 7 Brew modify the Computer System's specifications and components periodically?

- (2) We may periodically modify the Computer System's specifications and components.
Our modification of Computer System specifications and/or other technological developments or events may require you to purchase, lease, or license new or modified computer components, software, and peripherals and to obtain service and support for the Computer System.

What This Means (2025 FDD)
According to the 2025 FDD, 7 Brew can periodically modify the specifications and components of the Computer System that franchisees are required to use. This includes the computer hardware and software, point-of-sale system, related accessories, tablets, smartphones, and online ordering systems. These modifications may require franchisees to purchase, lease, or license new or modified computer components, software, and peripherals, as well as obtain service and support for the updated Computer System. Franchisees are responsible for these costs, which are separate from any Tech Fees paid to 7 Brew. Franchisees must implement these changes within 60 days of receiving notice from 7 Brew.
This policy means that franchisees must stay current with 7 Brew's technology standards, which may involve unexpected expenses for new equipment, software, or support services. While the FDD does not provide an estimate of these future costs, it emphasizes that franchisees are obligated to bear them. This is a common practice in franchising, where franchisors update technology to maintain brand standards and operational efficiency. However, it places a financial burden on franchisees to adapt to these changes.
Despite the obligation to use and maintain the Computer System according to 7 Brew's standards, franchisees are solely responsible for acquiring, operating, maintaining, and upgrading the system. They are also responsible for how their Computer System interfaces with 7 Brew's and any third party's systems, and for any consequences resulting from improper operation or maintenance. Furthermore, franchisees must ensure ongoing compliance with Payment Card Industry Data Security Standards and all applicable laws, including privacy laws, related to Consumer Data and the Computer System. This allocation of responsibility means that while 7 Brew mandates the technology, the franchisee bears the risk of managing and securing it effectively.
