Answer from 2025 FDD Document

  • (1) You must find, obtain our written acceptance of, and secure a site for the Store following the procedures specified in the Development Rights Rider to which we and you (or your affiliate) are parties. We make no representations or warranties of any kind, express or implied, about a site's suitability for a 7 BREW Store. Our recommendation or acceptance of a site indicates only that we believe the site is not inconsistent with sites that we regard as favorable or that otherwise have been successful sites in the past for 7 BREW Stores. Applying criteria appearing effective with other sites might not accurately reflect the potential of all sites, and demographic or other factors included in or excluded from our criteria could change, altering a site's potential. The uncertainty and instability of these criteria are beyond our control, and we are not responsible if a site fails to meet your expectations.

What This Means (2025 FDD)

According to 7 Brew's 2025 Franchise Disclosure Document, 7 Brew does not provide any express or implied warranties regarding a site's suitability for a 7 Brew store. 7 Brew's recommendation or acceptance of a site only indicates that they believe the site aligns with characteristics of previously successful locations. However, 7 Brew emphasizes that the criteria used to evaluate sites may not accurately predict the potential of all locations. Demographic or other factors considered may change, which could alter a site's potential.

7 Brew clarifies that the uncertainty and instability of site selection criteria are beyond their control, and they are not responsible if a site fails to meet a franchisee's expectations. This means that while 7 Brew offers criteria and reviews potential sites, the ultimate responsibility for the site's success rests with the franchisee. Prospective franchisees should carefully consider this lack of warranty and conduct their own thorough due diligence when selecting a location.

This approach is fairly standard in the franchise industry, where franchisors often provide guidance but avoid guaranteeing specific outcomes due to the many variables affecting a location's performance. A 7 Brew franchisee should not solely rely on 7 Brew's approval but should also conduct independent market research, assess local competition, and consider factors such as traffic patterns and accessibility to make an informed decision about site selection. Given this, it would be wise for a prospective franchisee to seek professional advice from real estate experts familiar with the local market.
